General terms and conditions 

1. The lessor provides the lessee with a technically perfect rental property for personal use. 

2. At the end of the contract, the rented item must be returned in the same condition in which it was accepted, taking into account normal wear and tear. Damage caused through no fault of one’s own or normal wear and tear must be reported to the landlord. 

3. If the lessee culpably caused damage to the rental property, he is obliged to pay compensation to the lessor. The costs of a local repair workshop or directly from the manufacturer will be charged for compensation. 

4. The renter is liable for the loss of the rented item, regardless of fault, including damage resulting from an accident. 

5. Except in the case of intent or gross negligence, the Lessor shall not be liable for damage incurred by the Lessee or third parties as a result of the rental property or its use. 

6. The lessee undertakes to treat the rental property with care and to return it punctually and in a clean condition at the agreed time. 

7. The landlord points out that the rented property is to be supervised at all times and, if necessary, to be kept or secured against theft. 

8. In the event of loss or unrepairable damage of the rented item, the current market value of the rented item is to be reimbursed to the lessor. 

9. The change of date or cancellation of the rented item by the tenant is free of charge if the tenant announces the change of date or cancellation by telephone up to 1 hour before the appointment on the day of the appointment. In the case of later cancellations, a fee of EUR 30.00 will be charged. 

10. The lessee confirms that the users of the rental property are swimmers. Life jackets are compulsory for all users of our boats. Own vests are desired, otherwise they can be rented. The landlord excludes liability for personal injury. Users are made aware of the need to wear life jackets due to the risk of accidents. Life jackets are compulsory.

The life jackets are provided by the lessor free of charge. 

Inflatable swimming aids are not allowed. Use of the rented property is only permitted in compliance with local guidelines, disregard is expressly prohibited. 

11. The users will be provided a water resistant bag free of charge which is included in the package, the user is liable for how he stores his own goods aboard the boats and we can not ensure that the goods will not be damaged due to wrong use.

12. click my business (www.Mosel-Kajak.de)(Moselstr. 51A, 54439 Palzem, Germany) is not liable for personal injury, property damage or transport damage as it is purely a rental service.  

No liability is assumed for lost or damaged valuables, ID cards, mobile phones, cameras etc. The landlord is not liable, either contractually or out of contract, for any damage incurred by the user or third parties in connection with the rental of the rented items. The user will taken liable and exempts the lessor in the event of third party claims due to accidents.  

The user exempts the lessor from all claims arising from the violation of laws, ordinances or other regulations in connection with the use of the rented items by him or a third person. 

13. If unforeseen circumstances occur that make it impossible to return the rental equipment in good time or require a premature termination, the customer is obliged to inform the rental company immediately so that a simple and cost-effective solution can be agreed upon. If, in order to safeguard his interests and/or to avoid possible damage/loss of material, the lender feels compelled to take back the rental material in whole or in part – contrary to the agreements – the lessee named in the rental agreement shall bear the costs. For salvage etc. of the item(s), €50.00* per hour and €1.50* per kilometer for the vehicle plus the usual transport costs will be charged (* plus statutory VAT). Any material damage caused by the behavior of the lessee or one of his participants must be borne by the lessee/client.
